Object Counter Application
Object Counter is intended to be used with users' own images and content. Users are responsible for ensuring they have the necessary rights and permissions for any images they process through the Application. By using Object Counter, you agree to these Terms of Service and acknowledge that you have read and understood them.
Thank you for choosing Object Counter ("Object Counter," "we," "us," "our"). Object Counter is an advanced mobile application for iOS and Android platforms, designed to help you count and track objects in images using manual counting and AI-powered detection features.
By downloading, installing, or using the Object Counter mobile application ("Application" or "App"), available through the Apple App Store, Google Play Store, or our website, you acknowledge that you have entered into a binding contract with Object Counter.
Your agreement with us includes these Terms of Service and any additional terms you agree to, including our Privacy Policy (collectively referred to as the "Agreements"). If you do not agree with or cannot comply with the Agreements, you must not access or use Object Counter.

Free tier users are subject to monthly usage limits as specified in the Application. Technical issues may occur, and we may interrupt access to Object Counter for maintenance or improvements. You may receive notifications about upgrades, new features, or maintenance from Object Counter.
You can upgrade to our Premium version of Object Counter by paying a subscription fee on a monthly, annual, or other recurring basis, as disclosed prior to your purchase. The Premium version offers additional features, including:
We may change the price for the Premium version, and we will communicate any price changes in advance, along with instructions on how to accept the changes. By continuing to use Object Counter after the price change, you accept the new price. If you disagree with a price change, you can reject it by unsubscribing from the Premium subscription before the change takes effect.
You understand and agree that your subscription and payment for the Premium version of Object Counter will automatically renew at the end of the current subscription period unless you cancel it before that time.
To cancel your subscription:
The cancellation will take effect at the end of the current subscription period. Please note that we do not provide refunds or credits for partial subscription periods, following standard industry practices.
Object Counter and all associated intellectual property, including trademarks, patents, copyrights, proprietary code, design elements, and branding ("Object Counter Intellectual Property"), are the exclusive property of Umair Khalid Siddique and Object Counter.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Object Counter Application solely for counting and tracking objects in your own images ("License"). This License remains effective until terminated by you or Object Counter.
You acknowledge and warrant that:
Object Counter is not liable for any copyright infringement or intellectual property violations arising from your use of the Application. We do not store, monitor, or control the images you process, and we have no obligation to protect or enforce copyrights on your behalf.
Except for the rights explicitly granted in these Agreements, you must not:
You are solely responsible for all images, content, and data you process using Object Counter ("User Content"). Object Counter is not responsible for User Content, nor do we endorse any content processed through the Application.
You retain all ownership rights to your User Content. Object Counter does not claim any ownership of your images, counting results, or projects. As stated in our Privacy Policy, we do not collect, store, or access your User Content.
Object Counter respects all laws, agreements, and intellectual property rights, and we expect you to do the same. The following actions are strictly prohibited:
Violation of these guidelines may result in immediate termination or suspension of your Object Counter account without prior notice.
Object Counter integrates with certain third-party services to provide enhanced functionality:
When you use AI-powered object detection features, images may be temporarily processed by OpenAI's Vision API. By using this feature, you acknowledge and agree to the temporary processing of your images by this third-party service. Images are not stored after processing is complete.
In-app purchases and subscriptions are processed through Apple App Store (iOS) and Google Play Store (Android), as well as RevenueCat for subscription management. These services have their own terms of service and privacy policies.
Object Counter is not responsible or liable for any third-party services, their content, or their practices. Your use of third-party services is governed by their respective terms and policies.
Object Counter will make reasonable efforts to ensure the continuous operation of the Application. However, technical difficulties, maintenance, updates, or changes in laws and regulations may result in temporary interruptions.

Any claim against Object Counter must be commenced within one (1) year after the date you first knew or reasonably should have known of the act, omission, or default giving rise to the claim. Failure to assert a claim within this time period shall result in the loss of any right to remedy for that claim.
You agree to indemnify, defend, and hold harmless Object Counter, its owner, employees, agents, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:
The Object Counter Application may be subject to export control laws and regulations. You agree to comply with all applicable export and import laws and regulations, and you warrant that you are not located in any country subject to economic sanctions or embargoes.
You acknowledge that certain third parties, including app store providers (Apple App Store, Google Play Store) and service providers (RevenueCat, OpenAI), are intended beneficiaries of these Terms and have the right to enforce them directly against you.
These Terms of Service, together with our Privacy Policy and any other agreements you enter into with Object Counter, constitute the entire agreement between you and Object Counter and supersede any prior agreements, whether written or oral.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
The failure of Object Counter to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Object Counter may assign these Terms or any rights under them without restriction. You may not assign these Terms or transfer any rights to any third party without our prior written consent.
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which the owner resides, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of Object Counter shall be resolved in the courts of competent jurisdiction in that location.
If you have any dispute with Object Counter, we encourage you to contact us first at umairkhalidsidd@gmail.com to attempt to resolve the issue informally.
If we cannot resolve the dispute informally, you and Object Counter agree that any dispute, claim, or controversy will be resolved through binding arbitration or small claims court, rather than in courts of general jurisdiction.
YOU AND OBJECT COUNTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
